Ministry of Labor began to develop a draft concept of Social Code
At the instruction of the Head of State, the Ministry of Labor and Social Protection of the Population of the Republic of Kazakhstan, together with experts, is developing a draft concept of the Social Code, which is planned to be submitted for consideration by the Interdepartmental commission on legislative activities in July this year, Kazpravda.kz reports with reference to the press service of the Ministry of Labor and Social Protection of the Republic of Kazakhstan.
The purpose of the development of the Social Code is to create institutional, economic and organizational conditions for citizens to exercise their social rights and interests.
"Currently, Kazakhstanis are provided with a wide range of social security measures, which are regulated by 1 code, 16 laws and more than 100 by-laws. The main goal of the new Code is to accumulate all the current legislative norms in this area in one document in order to make it easier for the population to understand them. The Social Code will be developed taking into account the proposals of citizens and will include sections related to each period of a person's life. This will allow Kazakhstanis to easily navigate the measures of state support," said Akmadi Sarbasov, First Vice Minister of Labor and Social Protection of the Population of the Republic of Kazakhstan.
According to him, the adoption of the Code will not only simplify the understanding of social legislation by the population, but will also provide a unified style of presentation of regulatory legal acts (a number of laws in the field of social security were adopted in the early 90s, since then approaches to the development of regulatory legal acts have changed significantly).
Also, within the framework of the Code, the social rights of citizens will be systematized - one document will indicate all the basic rights arising in a person's life in all spheres of life, including minimum social standards.
As part of the development of the Concept, a working group was created with the participation of more than 100 experts in various social areas, including deputies of the Parliament of the Republic of Kazakhstan, central state bodies, non-governmental organizations, public councils, as well as initiative citizens.
In the course of the work of the working group, more than 30 legislative and 150 by-laws of the Republic of Kazakhstan, as well as international experience in regulating social legislation, were studied.
Based on the results of the meetings with the population and public associations, the working group collected and considered about 500 proposals.
The working group offers to form the Code of two parts - general and specific.
In the general part, the foundations of the legal regulation of social relations between the state and the citizen are established with a clear definition of their mutual obligations.
A special part is devoted to certain types of social risks, where measures of response to them, categories of recipients of social assistance, the amount of payments, conditions and terms of their appointment will be determined.
After the approval of the Concept, the MLSPP will start developing the Social Code itself.
As previously reported, in his Address to the people of Kazakhstan dated September 1, 2020, the Head of State instructed to start work on consolidation of social legislation through the development and adoption of the Social Code.
